Official OSC Manufacturing and Equipment Services, Inc. TB210 Raffle Rules and Regulations

This contest is intended for legal residents of the 50 United States, District of Columbia, and Canada ONLY. DO NOT ENTER UNLESS YOU MEET THE ELIGIBILITY CRITERIA. Contestants are NOT required to be present the day of the contest (May 3rd, 2019 at 12:30 pm) at OSC Manufacturing and Equipment Services, Inc. at 1001 E. Delavan Avenue, Buffalo, NY, 14215. NO PURCHASE NECESSARY TO WIN; A PURCHASE OR RENTAL WILL NOT INCREASE YOUR ODDS OF WINNING.

(1) Eligibility: The contest is intended for legal residents of the 50 United States, the District of
Columbia, and Canada only, who are 21 years of age or older on the day of the contest.

(2) Overview: Eligible contestants may enter the contest by purchasing a raffle ticket prior to the day of the contest (May 3rd, 2019 at 12:30pm). Tickets cost $100, and only six hundred (600) tickets will be sold in total.
The contest will proceed as a raffle, with all pre-purchased tickets eligible to win. The drawing will begin at 12:30pm; all eligible tickets must be purchased prior to that time. The winner will be one ticket drawn at random.

(3) Registration: In order to be eligible to participate, contestants must purchase a ticket from an authorized OSC Manufacturing & Equipment Services, Inc. employee or an authorized OSC Holdings, Inc. employee PRIOR to May 3rd, 2019 at 12:30pm. Need not be present to win.

(4) Prize Details: An authorized OSC Holdings, Inc. or OSC Manufacturing and Equipment Services, Inc. representative will pull one (1) winning ticket(s) and the bearer of that ticket shall be entitled to receive a Takeuchi TB 210 Mini-Excavator (“THE PRIZE”):

(5) General Rules: THE PRIZE is subject to a general release of liability. IN ADDITION, OSC Holdings, Inc., OSC Manufacturing and Equipment Services, Inc. and any subsidiaries thereof assume no liability or responsibility for any failure by contestants to successfully redeem or validate contest tickets. Upon receipt of a validated winning ticket, OSC Holdings, Inc., and OSC Manufacturing & Equipment Services, Inc., shall deliver THE PRIZE to the bearer of the validated winning ticket. Contest winner shall be responsible for all transportation and maintenance costs of THE PRIZE, absent written agreement by an authorized employee of OSC Holdings, Inc. or OSC Manufacturing & Equipment Services, Inc. THE PRIZE shall be delivered in “new” condition; however, upon receipt of THE PRIZE by the contest winner, OSC Holdings, Inc., OSC Manufacturing & Equipment Services, Inc., and any affiliates or subsidiaries thereof, disclaim all liabilities and warranties, including warranties of merchantability and fitness for a particular purpose, and the contest winner bears sole responsibility for the proper use and maintenance of THE PRIZE. The contest winner, by accepting THE PRIZE, agrees to abide by all applicable laws and regulations.
ALL ENTRIES ARE SUBJECT TO VERIFICATION including verification of ticket UNVALIDATED TICKETS ARE INELIGIBLE FOR THE PRIZE AND WILL RESULT IN
FORFEITURE. No substitution of THE PRIZE will be offered; contestant winner will be solely responsible for any taxes on THE PRIZE. If for any reason the contest is unable to run as planned, OSC Manufacturing and Equipment Services, Inc. reserves the right, at its sole discretion, to cancel, modify, or terminate the contest. Further, OSC Manufacturing and
Equipment Services, Inc., at its sole discretion, reserves the right to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the
Contest; (b) violating the Official Rules; or (c) acting in an unsportsmanlike, unprofessional, or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. OSC
Manufacturing and Equipment Services, Inc. reserves the right to require winners to submit to a confidential background check to confirm eligibility as a condition of awarding any prize to help ensure that the use of any such person in advertising or publicity for the contest will not bring OSC Holdings, Inc., OSC Manufacturing and Equipment Services, Inc. or any affiliate or subsidiary thereof into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the contest as determined by OSC Manufacturing and Equipment Services, Inc. in its sole discretion. Contestants agree that OSC Manufacturing and Equipment Services, Inc. has the sole right to decide all matters and disputes arising from the contest and that all decisions of OSC
Manufacturing and Equipment Services, Inc. are final and binding. This contest is governed by the laws of the State of New York; by entering the contest, contestants agree that all claims or disputes be resolved in the federal or state courts located in Buffalo, NY.
(6) Limitations of Liability and Release: No liability or responsibility is assumed by OSC
Holdings, Inc., OSC Manufacturing and Equipment Services, Inc. or any affiliate or subsidiary thereof from any contestant’s participation in or attempt to participate in the contest or ability or inability to enter the same. No responsibility or liability is assumed by OSC Holdings, Inc., OSC Manufacturing and Equipment Services, Inc. or any affiliate or subsidiary thereof for any technical difficulties or issues which may affect the operation of the contest. OSC Holdings, Inc., OSC Manufacturing and Equipment Services, Inc. or any affiliate or subsidiary thereof are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the web site. Further, OSC Holdings, Inc., OSC Manufacturing and Equipment Services, Inc. and any affiliate or subsidiary thereof take no liability or responsibility for any personal injury, property damage, or losses of any kind sustained by any parties resulting from any use of THE PRIZE by contest winner. By participating in the contest, contestant releases OSC Holdings Inc., OSC Manufacturing and Equipment Services, Inc. and any affiliate or subsidiary thereof, from any and all claims, damages or liabilities arising from or relating to such contestant's participation in the contest. By accepting a prize, winners agree that OSC Manufacturing and Equipment Services, Inc., OSC Holdings, Inc., and any affiliate or subsidiary thereof shall not be liable for any loss or injury resulting from participation in the contest, or the acceptance or use of any prize. Further, OSC Manufacturing and Equipment Services, Inc., OSC Holdings, Inc., and any affiliate or subsidiary thereof are not liable in the event that any portion of the contest or scheduled events are cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control.

(7) Overview: Eligible contestants may enter the contest by being present the day of MAY 5th, 2017 at 1pm, at OSC Manufacturing and Equipment Services, Inc. at 1001 E. Delavan Avenue, Buffalo, NY, 14203. The contest will proceed as a raffle, with all present, registered and holding a validated ticket at the time of the drawing eligible to participate. Winner must be present to claim prize; ticket must be validated on MAY 5th, 2017, by an authorized OSC Holdings, Inc., or OSC Manufacturing and Equipment Services, Inc. employee.

(8) Registration: Upon arrival at OSC's Annual Equipment Expo (herein after THE EVENT), eligible contestants will be given a ticket and must have it validated and collected. At 1 pm, an authorized OSC Holdings, Inc., an OSC Manufacturing and Equipment Services, Inc. employee or designated representative will pull three (3) validated tickets. The holder(s) of those tickets will be declared the winner(s) and will be eligible to redeem the ticket(s) before close of business on MAY 5th, 2017.(9) Prize Details: An authorized OSC Holdings, Inc. or OSC Manufacturing and Equipment Services, Inc. representative will pull three (3) winning tickets and the values of each shall be as follows: (1) a rental credit worth five-hundred dollars ($500.00); (2) a rental credit worth one-thousand dollars ($1,000.00); and (3) a rental credit worth one-thousand and five-hundred dollars ($1,500.00)(collectively, "THE PRIZES") . THE PRIZES are free to be used by the winner(s) subject to the following conditions:

(10) General Rules: All prizes, including the rodeo and the rental credits, are subject to standard releases and waivers of liability found: (i) in the standard OSC Manufacturing and Equipment Services, Inc. rental agreement (in regards to the rental credits) and (ii) on forms to be prepared for participants in the rodeo by OSC Manufacturing and Equipment Services, Inc. (in regards to the rodeo).

By accepting a prize, winners agree that OSC Manufacturing and Equipment Services, Inc., OSC Holdings, Inc., and any affiliate or subsidiary thereof shall not be liable for any loss or injury resulting from participation in the contest, or the acceptance or use of any prize.
